				<Title>Amendment to section 35 of the Act (Equality of treatment)</Title>

								<Text>Section 35 of the Government of Wales Act 2006 (c.32) (“the Act”) is amended as follows.</Text>
							</P2para>
						</P2>
						<P2>
							<Pnumber>2</Pnumber>
							<P2para>
								<Text>For subsection (1), substitute—</Text>
								<BlockAmendment Context="schedule" Format="default" TargetClass="primary" TargetSubClass="unknown">
									<Text>“(1) The official languages of the Assembly are English and Welsh.</Text>
									<Text>(1A) The official languages must, in the conduct of Assembly proceedings, be treated on a basis of equality.</Text>
									<Text>(1B) All persons have the right to use either official language when participating in Assembly proceedings.</Text>
									<Text>(1C) Reports of Assembly proceedings must, in the case of proceedings which fall within section 1(5)(a) (proceedings of the Assembly), contain a record of what was said, in the official language in which it was said, and also a full translation into the other official language.</Text>
									<Text>(1D) Paragraph 8 of Schedule 2 makes provision about how the Assembly Commission must enable effect to be given to subsections (1) to (1C) .”</Text>

				<Title>Amendment to Schedule 2 to the Act (Assembly Commission)</Title>

								<Text>Paragraph 8 of Schedule 2 to the Act (Principles in accordance with which functions are to be exercised) is amended as follows.</Text>

							<Pnumber>2</Pnumber>
							<P2para>
								<Text>For sub-paragraph (3), substitute—</Text>

											<Text>The Assembly Commission must, in the exercise of its functions—</Text>

													<Text>treat the official languages of the Assembly on a basis of equality, and</Text>

													<Text>publish,</Text>

										<Pnumber>“the Scheme”</Pnumber>

											<Text>scheme, to be known as the Assembly Commission’s Official Languages Scheme (“the Scheme”), specifying the measures which it proposes to take in order to comply with its duties under sub-paragraph (3).</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>5</Pnumber>
										<P3para>
											<Text>The Scheme must include (amongst other things) provision a bout —</Text>
											<P4>
												<Pnumber>(a)</Pnumber>
												<P4para>
													<Text>simultaneous interpretation from one official language into the other —</Text>
													<P5>
														<Pnumber>(i) in all Assembly proceedings ,</Pnumber>
														<P5para>
															<Text>(i) in all Assembly proceedings ,</Text>
														</P5para>
													</P5>
													<P5>
														<Pnumber>(ii) in public meetings conducted on behalf of the Assembly Commission, and</Pnumber>
														<P5para>
															<Text>(ii) in public meetings conducted on behalf of the Assembly Commission, and</Text>
														</P5para>
													</P5>
													<P5>
														<Pnumber>(iii) in such other meetings connected with the functions of the Assembly or the Assembly Commission as may be provided for in the Scheme,</Pnumber>
														<P5para>
															<Text>(iii) in such other meetings connected with the functions of the Assembly or the Assembly Commission as may be provided for in the Scheme,</Text>
														</P5para>
													</P5>
												</P4para>
											</P4>
											<P4>
												<Pnumber>(b)</Pnumber>
												<P4para>
													<Text>publication of documents in both official languages , subject to any exceptions identified in the Scheme,</Text>
												</P4para>
											</P4>
										</P3para>
									</P3>
									<P3>
										<Pnumber>c</Pnumber>
										<P3para>
											<Text>public engagement with—</Text>
											<P5>
												<Pnumber>(i) Assembly proceedings, and</Pnumber>
												<P5para>
													<Text>(i) Assembly proceedings, and</Text>
												</P5para>
											</P5>
											<P5>
												<Pnumber>(ii) other functions of the Assembly and of the Assembly Commission,</Pnumber>
												<P5para>
													<Text>(ii) other functions of the Assembly and of the Assembly Commission,</Text>
												</P5para>
											</P5>
											<P4>
												<Pnumber>through the medium of either of the official languages,</Pnumber>
												<P4para>
													<Text>through the medium of either of the official languages,</Text>

												<Pnumber>(d)</Pnumber>
												<P4para>
													<Text>practical measures to foster and continually improve freedom of choice of official language—</Text>

														<Pnumber>(i) on the part of those participating in Assembly proceedings, and</Pnumber>

															<Text>(i) on the part of those participating in Assembly proceedings, and</Text>
														</P5para>
													</P5>
													<P5>
														<Pnumber>(ii) in relation to the functions of the Assembly or the Assembly Commission generally,</Pnumber>

													</P5>
												</P4para>
											</P4>
										</P3para>
									</P3>
									<P3>
										<Pnumber>e</Pnumber>

											<Text>the setting of targets and timescales relating to implementation of the Scheme,</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>f</Pnumber>
										<P3para>
											<Text>the allocation of responsibilities for implementing the Scheme,</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>g</Pnumber>
										<P3para>
											<Text>objective means of measuring progress in implementing the Scheme, and</Text>
											<P4>
												<Pnumber>(h)</Pnumber>
												<P4para>
													<Text>a strategy for ensuring that the staff of the Assembly have, collectively, the language skills necessary to enable the Scheme to be implemented .</Text>
												</P4para>
											</P4>
										</P3para>
									</P3>
									<P3>
										<Pnumber>6</Pnumber>
										<P3para>
											<Text>The Scheme must include provision relating to the receipt, investigation and consideration of complaints of failures to give effect to provisions of the Scheme.</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>7</Pnumber>
										<P3para>
											<Text>The Scheme must identify those services provided or to be provided in the official languages and explain how those services are to be provided in accordance with paragraph 8(5).</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>8</Pnumber>
										<P3para>
											<Text>The Assembly Commission must, in respect of each financial year, lay before the Assembly a report setting out how the Commission has, during the year in question, given effect to the Scheme.</Text>
										</P3para>
									</P3>
									<P3>
										<Pnumber>9</Pnumber>
										<P3para>
											<Text>The report prepared by the Assembly Commission under sub-paragraph (8) must include—</Text>
											<P4>
												<Pnumber>(a)</Pnumber>
												<P4para>
													<Text>whether and to what degree the services referred to in sub-paragraph (7</Text>
												</P4para>
											</P4>
											<P4>
												<Pnumber>(b)</Pnumber>
												<P4para>
													<Text>if applicable, the reasons why the Commission has not provided any of the services referred to in sub-paragraph (7</Text>
												</P4para>
											</P4>
										</P3para>
									</P3>
									<P3>
										<Pnumber>10</Pnumber>
										<P3para>
											<Text>The Assembly Commission—</Text>
											<P4>
												<Pnumber>(a)</Pnumber>
												<P4para>
													<Text>must review the Scheme as soon as is reasonably practicable after each ordinary general election, or after an extraordinary general election to which section 5(5</Text>
												</P4para>
											</P4>
											<P4>
												<Pnumber>(b)</Pnumber>
												<P4para>
													<Text>may, at any time, adopt a new Scheme or an amendment to the existing Scheme.</Text>
												</P4para>
											</P4>
										</P3para>
									</P3>
									<P3>
										<Pnumber>11</Pnumber>
										<P3para>
											<Text>The Assembly Commission may not adopt a Scheme, or an amendment to a Scheme, unless (whether before or after the coming into force of this paragraph)—</Text>
											<P4>
												<Pnumber>(a)</Pnumber>
												<P4para>
													<Text>a draft of the Scheme (or of the amendment</Text>
													<P5>
														<Pnumber>(i) published, and</Pnumber>
														<P5para>
															<Text>(i) published, and</Text>
														</P5para>
													</P5>
													<P5>
														<Pnumber>(ii) laid before the Assembly,</Pnumber>
														<P5para>
															<Text>(ii) laid before the Assembly,</Text>
														</P5para>
													</P5>
												</P4para>
											</P4>
											<P4>
												<Pnumber>(b)</Pnumber>
												<P4para>
													<Text>the Assembly Commission has given—</Text>
													<P5>
														<Pnumber>(i) those persons whom the Assembly Commission considers it appropriate to consult in relation to the Scheme, and</Pnumber>

															<Text>(i) those persons whom the Assembly Commission considers it appropriate to consult in relation to the Scheme, and</Text>

													</P5>
													<P5>
														<Pnumber>(ii) the Assembly,</Pnumber>

											</P4>
											<P4>
												<Pnumber>reasonable opportunity to make representations in relation to the draft,</Pnumber>
